DEFINITION

A surplus lines broker is an individual or business authorized under specified circumstances to procure insurance from "unauthorized insurers" -- insurance companies that do not hold an Arizona-issued certificate of authority. ARS § 20-407.

A Mexican insurance surplus lines broker is an individual or business authorized to solicit or accept applications in Arizona for insurance issued by an alien or unauthorized insurer that will be effective only in Mexico. ARS §§ 20-411.01 and 20-422.

WHO MUST BE LICENSED

An individual or business entity must be licensed as a surplus lines broker or Mexican insurance surplus lines broker to procure insurance from an unauthorized insurer. ARS §§ 20-411(A), 20-411.01 and 20-422.

APPLICATION REQUIREMENTS (not an exhaustive list)

Not everyone qualifies for an insurance license. The Department can deny a license for any cause listed in Arizona Revised Statutes ("ARS") § 20-295. You should review this statute before deciding to spend the time, effort and money to apply for a license. If you apply for a license, you must truthfully and completely answer questions asked on the application, and you may need to provide additional documentation.

GENERAL REQUIREMENTS	Common to All Applicants
Maintain an Arizona office location	If applying for a Mexican insurance surplus lines broker license, you must have and maintain an office within Arizona. ARS § 20-411.01
Licensed individuals within Arizona office locations	In each of your office locations, at least one individual must be licensed as a property and/or casualty insurance producer or as a property and/or casualty managing general agent and must be licensed as a surplus lines broker or Mexican insurance surplus lines broker.
